Terms of sale

You are buying from Montana Property Reports, LLC. These terms cover the paid reports we sell. The disclaimer forms part of them and sets out what each dataset can and cannot tell you.

1.Who you are buying from

Montana Property Reports, LLC is a Montana limited liability company based in Livingston, Montana (“we”, “us”, “our”). These terms are an agreement between you and Montana Property Reports, LLC. We are independent. We are not affiliated with, endorsed by, or acting on behalf of the State of Montana, any of its agencies, or any federal agency whose public records these reports draw on.

2.What you are buying

You are buying the gathering, organization and analysis of public records for one property, delivered as a report. You are not buying the records themselves, which are public, and you are not buying a guarantee about the property. What the report covers, and what it cannot settle, is set out in the schedule below and on the disclaimer page, which forms part of these terms.

3.Delivery

Reports are generated and delivered by email, and where the site offers it, as a downloadable PDF and a private link. Delivery is normally immediate to within a few minutes. The schedule below states this product’s delivery commitment. If we fail to deliver within the stated window, you are entitled to a full refund whether or not you ask for one.

4.Price and payment

Prices are shown before purchase and are charged in US dollars through Stripe. We do not see or store your full card number.

Prices may change. A change never affects a purchase already completed. This site sells a single one-time report; it offers no subscription, and nothing here renews.

5.Seven-day satisfaction refunds

Only the product types actually offered on this site apply. This site sells a one-time report, so nothing here creates an automatic renewal or a subscription.

If a report is not useful to you, request a full refund within seven calendar days after it is first delivered or made available to you. No explanation is required. Viewing the report, downloading the PDF, or using the private link during the window does not by itself disqualify you.

This applies whether the report told you something you did not want to hear, whether it was thin because the public record is thin, or whether you simply did not find it useful. A report that shows a hard building site has done its job, and we would rather refund you than argue about it.

Submit your request through the contact form, choosing “Refund request”, or simply reply to the email your report arrived in. Include enough information to identify the purchase. The deadline is 11:59 p.m. Mountain Time on the seventh calendar day after delivery. A request received by that deadline qualifies even if we process it later.

Refunds go to the original payment method unless another method is legally required or agreed. Bank processing times can vary.

After the satisfaction window we do not promise discretionary change-of-mind refunds. That does not affect refunds or other remedies required by applicable law.

Failure to deliver as promised, duplicate or unauthorized charges, materially misdescribed products, and other legally protected claims are not extinguished by this seven-day deadline. Any more favorable express delivery or refund promise made for your purchase also applies. Seven days is a voluntary satisfaction window, not a deadline that removes rights and remedies that cannot lawfully be waived.

6.What these reports are not

No report we sell is:

  • legal advice, or a title opinion, or title research
  • engineering, geotechnical or hydrogeologic certification
  • land surveying, or any determination of a boundary
  • an appraisal or an opinion of value by a licensed appraiser
  • a permit, an approval, or a determination by any government body
  • a guarantee that a property can or cannot be built on, drilled on, insured, or financed

Mapped is not determined. Outside a mapped high-risk flood area is not the same as no flood risk. A mapped wetland is not a jurisdictional delineation. A road on a map is not legal access. A modeled wildfire figure is not an assessment of your house.

Decisions with money attached — buying land, drilling a well, extending credit, starting construction — should involve a licensed professional and the responsible county office. These reports are built to make that conversation better informed, not to replace it.

7.Accuracy and the limits of the source data

We do not create the underlying records and cannot warrant their accuracy or completeness. Government datasets carry their own scale limits and their own lag, and our sources page states them. Where the record is thin, our reports say so and lower their stated confidence. We do not fill gaps with invented text. If you believe a figure is wrong, tell us: we would rather correct it than defend it.

8.Acceptable use

You agree not to:

  • scrape, bulk download, or systematically extract our reports or the database behind them
  • resell or redistribute reports as your own product, or remove our attribution
  • present our analysis as a certified professional opinion or as your own professional work
  • use a report to misrepresent a property to a buyer, a lender or a regulator
  • circumvent payment, share credentials, or reach paid analysis you have not bought

Sharing a report with the parties to a specific transaction — your client, their lender, their attorney, a contractor quoting the work — is expected and permitted.

9.Limitation of liability

To the maximum extent the law allows, our total liability arising out of a report or your use of these services is limited to the amount you paid us for it. We are not liable for indirect, incidental, consequential or punitive damages, including lost profits, a failed transaction, drilling or construction costs, or a change in property value.

This is a cap, not an escape. It reflects what the product honestly is: we charge tens of dollars to organize public records, and we cannot underwrite a land purchase or a building project.

The services are provided “as is”, without warranties of any kind, except as stated in section 10.

10.Rights we do not limit

Nothing in these terms limits or waives:

  • any liability for fraud, willful injury, or a willful or negligent violation of law
  • your rights under the Montana Unfair Trade Practices and Consumer Protection Act
  • any other right that cannot be waived by agreement under Montana law

If any part of these terms is held unenforceable, the rest continues to apply.

11.Changes

We may change the services and these terms. A material change is reflected in the effective date above, and continuing to use the services after a change means you accept it. A report you have already bought stays available and renders as it did when you bought it, with its own data vintage stamp.

12.Governing law

These terms are governed by the laws of the State of Montana, without regard to its conflict of law rules.

Schedule C

Montana Build Report

Product. Complete Build Report, $49, one time.

What it covers. Parcel, terrain, soils and septic outlook, flood zones, wetlands, mapped access, public land, zoning and regulatory contacts, and nearby development, for one parcel.

Delivery. Immediate on screen, with a downloadable PDF and a private shareable link.

What it cannot settle. It does not replace site inspection, title work, surveying, engineering, permitting or professional due diligence. It is not a septic approval, a wetland delineation, a zoning determination or a building permit, and it is not a guarantee that a property can or cannot be built on. Soil data is mapped at a scale its publisher states is not intended for site-specific permitting decisions. Roughly two thirds of Montana counties administer no general zoning outside incorporated cities, and where a county publishes none the report names the office to call rather than guessing.

Free tier. The property snapshot is free and needs no account.

Two products are named on our pricing page as coming later, deliberately not built yet: Build Report Plus at $99 and Realtor / Builder Pro at $99 a month. Neither is purchasable, neither has a Stripe price, and neither is covered by these terms until it exists.
